En el presente trabajo de investigación se realizó un estudio de la institución jurídica de denominada Suspensión Condicional del Procedimiento, sus antecedentes, beneficios y condiciones para su aplicación en delitos considerados de bagatela cuya pena no exceda los cinco años de prisión. De igual manera, se estableció que, al estar prevista en el Código Orgánico Integral Penal, vulnera los principios de: celeridad, economía procesal y mínima intervención penal, dentro de un proceso penal, en razón de que dicha institución jurídica ya (...) se encontraba prevista en nuestra legislación en el derogado Código de Procedimiento Penal. Esta investigación se realizó apoyándonos y sustentándonos a través de la doctrina, legislación comparada y la Constitución de la República. Para ello se realizó una investigación de tipo no experimental, haciendo uso de los métodos de investigación inductivo-deductivo, analítico-sintético y el exegético-jurídico. A partir de lo cual, se obtuvo como resultado que la no aplicación de la institución jurídica de la suspensión condicional del procedimiento vulnera los principios los principios de: celeridad, economía procesal y mínima intervención penal, por lo cual, se debería volver a incluir por parte del legislativo, a través de una reforma esta institución jurídica en el Código Orgánico Integral Penal como un mecanismo alternativo de solución de conflictos. Se concluye además que dicha institución jurídica trae consigo beneficios, tanto para la víctima, el procesado y el órgano jurisdiccional. (shrink)

El presente artículo aborda un tema relevante dentro del sistema judicial ecuatoriano, esto es la distinción entre el concurso de infracciones y la conexidad conforme lo establecido en el Código Orgánico Integral Penal. Dichas figuras jurídicas tienen finalidades distintas, a saber, el concurso de infracciones determina las reglas para la aplicación de penas, mientras que la conexidad establece las reglas de competencia, debiendo considerar que la finalidad de la conexidad es otorgar operatividad al concurso delictual en sus distintas modalidades. No (...) obstante, en el análisis realizado se logró identificar deficiencias normativas, lo cual incluso fue comparado con el derecho español, siendo este último referente en los temas estudiados, toda vez que la norma penal española ha desarrollado de mejor manera estas instituciones jurídicas. En este contexto, luego del análisis que se realizó dentro del presente artículo, se pone a consideración las deficiencias normativas identificadas y la necesidad imperiosa de establecer reformas legislativas, toda vez que es necesario que el Derecho Procesal ecuatoriano desarrolle instituciones jurídicas que permitan mejorar el sistema judicial, ya que al establecer reglas procesales precisas, permitirá que exista una aplicación justa y equitativa del Derecho Penal, lo cual permitirá garantizar a la sociedad en general el derecho a la seguridad jurídica y fortalecer el Estado de Derecho y justicia. This translation of Enrique Dussel's “‘Ser-Hispano’: Un Mundo en el ‘Border’ de Muchos Mundos” offers an interpretation of hispanos (Latin Americans and U.S. latinos) as historically, culturally, and geographically located “in-between” many worlds that combine to constitute an identity on the intercultural “border.” To illustrate how hispanos have navigated and continue to navigate their complex history in order to create a polyphonic identity, the essay sketches five historical-cultural “worlds” that come together to form the hispanic “world.”.

This article investigates the characteristics of the phenomenon of fear in work relationships in contemporary society. In this sense, the first part describes the dynamics of current life, emphasizing the role of organizations, their bad reputation, and characterizing their operational center as a society of performance. The second part describes the phenomenon of fear, starting from some representative origins of the term, Martin Heidegger’s phenomenological perspective, and recent studies within the field of organizations. Finally, a survey conducted in the first (...) semester of 2023 with 160 workers from different sectors about their perception of fear in the organization is presented. The findings are interpreted in light of the studied perspectives connected with the ethical responsibility of institutions and the pursuit of comprehensive well-being in work relationships. The need for a framework to justify that a model has sufficient credibility to be used as a basis for internal or external (typically regulatory) decision-making is a primary concern when using modelling and simulation (M&S) in healthcare. This chapter reviews published standards on verification, validation, and uncertainty quantification (VVUQ) as well as regulatory guidance that can be used to establish model credibility in this context, providing a potential starting point for a globally harmonised model credibility framework.

ABSTRACT This article reconstructs Oskar Negt and Alexander Kluge’s critical theory by articulating some of the key concepts of History and Obstinacy, their second collaboration. The objective is to detail the grounds of their critical theory and to show how it acquires its normative character. To this aim, in a first step, I reconstruct the basis of the anthropology developed by Negt and Kluge. This anthropology allows them to argue that subjects-insofar as they are creative beings-possess ‘obstinacy’, which they (...) understand as an intrinsic and material power to resist oppression. Following this, I discuss the concept of ‘primitive accumulation’, which is used by Negt and Kluge to expose the relation between capitalism and obstinacy. Finally, I clarify the way Negt and Kluge appeal to the concept of ‘human nature’ in order to show how their theory derives its normative character. To do so, I rely on Christoph Menke’s work on ‘inner nature’. (shrink)

In response to those calling for philosophical dialogue across the Americas, this paper considers the historical emergence of the concept of el pueblo (“the people”) as the subject and object of democracy. The first section makes a linguistic claim: the genuinely communal nature of “the people” clearly appears when considering el pueblo because it is unambiguously singular, grammatically speaking. The second section makes a historical claim: the microhistory of a largely indigenous pueblo in Mexico’s Yucatán enables us to begin unpacking (...) the complex concrete, historical, and genealogical dimensions of el pueblo. The brief concluding section suggests that historically contextualizing and concretizing el pueblo provides conceptual support for some of the premises that underwrite Latin American philosophies of liberation, including that of Enrique Dussel. -/- . My essay begins by providing a broad vision of how William James’s psychology and philosophy were a two-pronged attempt to revive the self whose foundations had collapsed after the Civil War. Next, I explain how this revival was all too successful insofar as James inadvertently resurrected the imperial self, so that he was forced to adjust and develop his philosophy of religion in keeping with his anti-imperialism. James’s mature philosophy of religion therefore articulates a vision of the radically ethical saint (...) religiously bound to a decidedly pluralistic universe. I evaluate James’s philosophy of religion by comparing it to Enrique Dussel’s psychological portrait of the imperialist ego, Dussel’s attempt to religiously bind this ego, and the more radical philosophy that results. I suggest that Dussel’s philosophy of liberation: 1) better theorizes the religious contraction of the self as a necessary part of ethical and political life and 2) offers a more concrete and radically democratic philosophy. My overarching aim is to show how Dussel’s liberation philosophy can help critically develop James’s pragmatist claim that religion might provide a force for widely and positively transforming our ethical and political lives. This essay suggests that the U.S.-American Pragmatist tradition could be fruitfully reconstructed by way of a dialogue with Latin American Liberation Philosophy. More specifically, I work to establish a common ground for future comparative work by: 1) gathering and interpreting Enrique Dussel’s scattered comments on Pragmatism, 2) showing how the concept of liberation already functions in John Dewey’s Pragmatism, and 3) suggesting reasons for further developing this inter-American philosophical dialogue and debate.

Trata-se, neste artigo, de investigar as noções de filosofia, pedagogia e espírito à luz dos debates decoloniais. Neste sentido, a partir de um diálogo que procuro estabelecer com Enrique Dussel, Catherine Walsh e M. Jacqui Alexander, desenvolvo três hipóteses. Em primeiro lugar, apresento certa noção de pedagogia como constitutiva da própria filosofia (portanto, a ideia de pedagogia para além de mero instrumento, meio ou termo acessório à filosofia). Em segundo lugar, argumento que essa dita pedagógica-filosófica precisará ser entendida (...) como a epistemologia indispensável para a abordagem, conhecimento e tratamento da realidade, no seguinte sentido: mediante o aprender e o ensinar alternadamente (como práxis, atitude e método filosófico por excelência), tornar possível que a realidade apareça. E esse é mais um dos pontos em relação aos quais os três autores estão de acordo, assim como em relação ao terceiro e mais importante movimento da presente investigação. Pois será, então, do reconhecimento do fracasso da ontologia universalista (moderna e colonial), mais precisamente, do encontro com uma realidade indeterminada e aberta, que se poderá a fundo compreender o sentido da atitude pedagógica (da epistemologia pedagógica) que descerra toda a realidade possível. Tal realidade_ _sempre Outra_ _– que não se pode localizar em qualquer lugar ou tempo, na mesma medida em que se faz presente em todos os lugares e momentos – é o que se poderá caracterizar como espírito. E é o que fará do espírito, por conseguinte, agência de resistência e perturbação a todo esforço epistemológico/filosófico, tanto quanto (e por isso mesmo) da atitude pedagógica-filosófica instância de revelação de um mundo prenhe de sentidos possíveis. This paper aims to provide an answer to James Woodward’s article “Flagpoles anyone? Causal and explanatory asymmetries”. It will be conjectured that, when causal directionality depends on the experimental design, it is because the variables involved are capable of producing changes in each other. This will be exemplified using the case of ideal gases as opposed to the flagpole-shadow scenario.

In the so-called "Spin-Echo Experiments" the behaviour of a spin's system seems to violate the second law of thermodynamics. For this reason the "Spin-Echo Experiments" are considered of particular interest for the Foundations of Physics. Interventionists have provided a classical explanation (Blatt, 1959; Ridderbos & Redhead, 1998) and a quantum-based explanation (Hemmo & Shenker, 2005) of these experiments. Here both interventionist explanations are assessed by means of the Manipulability Theory of Causal Explanation (Woodward, 2003). Se delimita la investigación a través de tesauros de Eric. Se plantearon preguntas de investigación relacionadas con las fuentes de datos, los autores y las redes de colaboración. La investigación evidencia incrementos en la producción a partir del año 2019, la nacionalidad de los autores y la filiación de instituciones (...) resaltan a través de redes de investigaciones extendidas en Iberoamérica. Se realizó una revisión sistemática de la literatura localizada en Scopus sobre la competencia digital (CD) del profesorado universitario; con ayuda de la metodología PRISMA y operadores se delimitó la investigación a través de tesauros de Eric. Los autores/entidades españolas resaltan en la temática, existen esfuerzos orientados al diseño, validación y aplicación de rúbricas a nivel mundial. Los abordajes predominantemente son cuantitativos. La investigación fortalece el entendimiento sobre la CD, existe un efecto positivo otorgado por las CD docentes en la (...) formación de estudiantes, se requiere desarrollar planes de formación y emprender esfuerzos similares en otras bases de datos científicas. I present a notion of invariance under arbitrary surjective mappings for operators on a relational finite type hierarchy generalizing the so-called Tarski-Sher criterion for logicality and I characterize the invariant operators as definable in a fragment of the first-order language. These results are compared with those obtained by Feferman and it is argued that further clarification of the notion of invariance is needed if one wants to use it to characterize logicality.

It is the ideals ofthe State that govern the educational process, and this in a double sense: schools should train pupils in these values, and at the same time reproduce these values in their functional processes. In this essay, Enrique Dussel provides a textual “rereading” of Karl Marx’s theory of fetishism according to his scattered but significantcomments on religion as they extend throughout the whole of his work. In Part I, “The Place of the Subject of Religion in the Whole Work of Marx,” Dussel demonstrates Marx’s differentiation between a critique of the essence of religion and its manifestations, arguing that there is a space in Marx for a anti-fetishized liberatory religion. In Part II, “Toward (...) a Theory of Fetishism in General,” he provides a methodological account of such a religion, as well as a panorama of the content of this essence of religion. In The Theological Metaphors of Marx, Enrique Dussel provides a groundbreaking combination of Marxology, theology, and ethical theory. Dussel shows that Marx unveils the theology of capitalism in his critique of commodity fetishization. Capitalism constitutes an idolatry of the commodity that undergirds the capitalist expropriation of labor. Dussel examines Marx's early writings on religion and fetishism and proceeds through what Dussel refers to as the four major drafts of Capital, ultimately situating Marx's philosophical, economic, ethical, and historical insights in (...) relation to the theological problems of his time. Dussel notes a shift in Marx's underlying theological schema from a political critique of the state to an economic critique of the commodity fetish as the Devil, or anti-God, of modernity. Marx's thought, impact, and influence cannot be fully understood without Dussel's historic reinterpretation of the theological origins and implications of Marx's critiques of political economy and politics. In this paper we will discuss the active part played by certain diagonal arguments in the genesis of computability theory. 1 In some cases it is enough to assume the enumerability of Y while in others the effective enumerability is a substantial demand. These enigmatical words by Kleene were our point of departure: When Church proposed this thesis, I sat down to disprove it by diagonalizing out of the class of the λ–definable functions. But, quickly realizing that the diagonalization cannot (...) be done effectively, I became overnight a supporter of the thesis. (1981, p. 59) The title of our paper alludes to this very work, a task on which Kleene claims to have set out after hearing such a remarkable statement from Church, who was his teacher at the time. There are quite a few points made in this extract that may be surprising. First, it talks about a proof by diagonalization in order to test—in fact to try to falsify—a hypothesis that is not strictly formal. Second, it states that such a proof or diagonal construction fails. Third, it seems to use the failure as a support for the thesis. Finally, the episode we have just described took place at a time, autumn 1933, in which many of the results that characterize Computability Theory had not yet materialized. The aim of this paper is to show that Church and Kleene discovered a way to block a very particular instance of a diagonal construction: one that is closely related to the content of Church's thesis. We will start by analysing the logical structure of a diagonal construction. Then we will introduce the historical context in order to analyse the reasons that might have led Kleene to think that the failure of this very specific diagonal proof could support the thesis. This is a joint paper. We have both attempted to add a small piece to an amazing historical jigsaw puzzle at a juncture we feel to be appropiate.
